You will see things worded just like on post cards that come in the mail, but in reality it is always referencing life insurance. I want to give this disclaimer because I don't want to mislead anyone. If this is enough to get the average senior to return a reply card for more information then I can easily say the same thing if I believe it will get your attention.  I work for a life insurance company that also sends advertisements in the mail, but the information you receive from us is company specific. The post cards that come which highlight a STATE REGULATED BENEFIT are not company specific, and will always trigger an insurance broker to show up at your home. Most of the time if you put your phone number on the card the agent will call in attempt to set an appointment. However they will also show up if you reject them over the phone or simple don't answer. As far as being state regulated, well that life insurance. An agent is licensed by the state/s in which they represent and so this the extent of what it has to do with the state. I get these same things in the mail and when I was a broker, I would have no choice but to pay a company to advertise for me, and this is also what I would operate with. Agent's don't really have a choice unless they plan to go door to door until they find someone interested. 
That's the facts. I agree it is misleading, and sometimes it almost appears to be a free offer. Really though it's hard to imagine someone actually believing there's some free money that becomes available when you die. People just want to make sure there family has the money to pay for their funeral, or even direct cremation. Burial or cremation, funeral services are not always necessary, but can be held for either option someone chooses to go with. No one wants to saddle their loved ones with the financial responsibility that comes with death. 
The last disclaimer I'll give you is that I work for the largest final expense company in America and because they do their own advertising for us agents, non of what I do with blogs or websites is necessary, and my agent contract even forbids me to use the company name or logo in paid social media posts, advertising landing pages, Youtube videos, ETC. It makes sense, since we have more agents than any other final expense life insurance company in America, If every agent did their own advertising then it's not hard to imagine how that could get out of hand and even have a negative impact on the integrity of the company.
